DEFINITION OF TERMS
• Member: A person who has concluded a written agreement with the Club regarding participation and use of services, and who agrees to comply with the Club's internal rules and other binding regulations.
• Visitor / Client: A person who visits MARIENBADES GYM and is entitled to receive Club services either through a concluded agreement or a paid one-time visit. This term includes both Members and short-term visitors.
• Club: A sports and fitness establishment providing Members and/or visitors with opportunities for physical activities, workouts, group classes, and related services, while setting the rules and regulations for their use.
• Party / Parties: Either the Club or the Member/Client.
• Subscription: A type, duration, and price of the Club service purchased according to the Club’s price list and regulations, granting the Member the right to use services within a specified time period or number of visits.
• Visit: A single use of a Club service, such as an individual workout or group class.
• Card: A Member identification card issued by the Club confirming the right to use services included in the Subscription. The card is valid only during the Subscription period.
• Agreement: A mutual arrangement between the Member and the Club regarding service use, rights, and obligations, executed in writing. Its terms are binding on both parties.
• Trainer: A certified person providing professional support during workouts, conducting classes, or offering consultations, employed by or cooperating with the Club.
• Administration / Club Representative: A person representing the Club, ensuring order, providing information about services, monitoring contract fulfillment, and coordinating Member cooperation with the Club.
• Force Majeure: Circumstances, including but not limited to natural disasters, pandemics, war, technical failures, or other external factors that objectively prevent the Club from providing services according to the Agreement.

General Conduct & Etiquette
1. All visitors, including Members and one-time clients, must follow the Club’s internal rules and behave respectfully to ensure a safe and comfortable environment for everyone.
2. Visitors must maintain cleanliness, order, and politeness at all times. Members should respect the peace and comfort of others while in the Club.
3. Smoking, bringing or consuming alcoholic beverages, and being under the influence of intoxicating substances is strictly prohibited anywhere on Club premises.
4. Eating personal food is not allowed in the Club premises to maintain hygiene and cleanliness.
5. Photography and filming in the Club, including changing rooms, is permitted only for personal use. Any other use requires prior written approval from Club administration. Visitors must ensure that no other persons are visible in photos or videos without their consent.
6. Visitors not registered for group classes must not interfere with ongoing classes or use equipment designated for those classes.
7. Visitors not participating in individual training with a certified Club trainer may not use equipment designated for that training, interfere with the session, or enter areas reserved for the trainer and/or their client.
8. Clients are prohibited from sharing, transferring, or otherwise disclosing information about other Club visitors, Members, or Club personnel, whether verbal, written, visual, or digital (including photos and videos), without written permission from the Club administration. Unauthorized disclosure is considered a serious breach of rules and may result in unilateral contract termination, access revocation, and other actions under Latvian law.
Club Operations & Changes
1. The Club reserves the right to change its working hours, price list, class schedules, or any other Club-related matters. Clients will be informed in advance whenever possible.
2. The Club may perform cleaning, maintenance, and equipment repair work. Every effort will be made to minimize inconvenience, but temporary unavailability of services may occur. Clients agree not to make claims regarding such temporary interruptions.
3. The Club may use its premises to organize events, which could result in temporary changes to working hours or restricted access to certain areas. Clients will be notified in advance via the Club website (www.mygym.lv/blog/) or other official channels.
4. All notices and correspondence from the Club are considered delivered to the client if five (5) business days have passed since sending, even if no direct confirmation is received.
5. The Club reserves the right to disregard requests for contract termination, changes, or training leave if such requests are not properly submitted in accordance with the Club’s procedures.
Health & Safety
1. The Club is equipped with video surveillance and fire detection systems. During working hours, a Club administration representative is always on duty to ensure safety and security.
2. Every visitor is responsible for their own workouts and health evaluation. If any health issues arise, it is recommended to contact a physician. Visitors must immediately inform a trainer or Club administration of any injuries or accidents. In case of an injury, this notification must occur before starting a workout or service.
3. The Club does not guarantee emergency medical assistance, but will take all possible measures to provide first aid and, if necessary, immediately call the state emergency medical service.
4. For safety and hygiene, visitors must wear sports-appropriate clothing and shoes. Sandals, outdoor shoes, or being barefoot are not allowed in the sports hall. In shower areas, slippers are recommended. Only indoor change shoes and clothing not worn outside are allowed.
5. Towels must be used while sitting in the sauna. Shaving, hair coloring, drying laundry, and other inappropriate activities are strictly prohibited. The use of oils, honey, or other body/facial care products in sauna or shower areas is not allowed, and pouring water on sauna stones is prohibited.
6. In emergency or critical situations, Club administration has the right to make immediate decisions to ensure the safety of visitors, staff, and Club property.
7. In cases of physical conflict, aggressive behavior, threats, or other prohibited activities, Club administration has the right and obligation to: restrict or deny further access to violators, document the incident, and contact the State Police or other relevant authorities if necessary.
8. The Club is not responsible for service interruptions or limitations caused by force majeure, including but not limited to natural disasters, technical failures, pandemics, or other external factors.
9. The Club is responsible to the client only in cases of intentional breach of obligations or gross negligence. Liability limitations do not apply in cases of fatal incidents or harm to health.
Membership Cards & Access
1. The Club Member card (if issued) is personal and may not be transferred, lent, or gifted to another person. Violation of this rule may result in cancellation of the Member card.
2. Club administration staff may request that visitors present their Member card and/or personal identification. Visitors are obliged to provide valid identification when requested.
3. Members must immediately notify Club administration if their Member card is lost. A replacement fee may apply according to the service price list.
4. Lockers are locked with keys issued individually before using Club services. Visitors must return the locker key to the administration after their visit. Lost keys may incur a compensation fee as specified in the service price list.
5. Lockers are for use only during Club operating hours and during the visitor’s session. Leaving personal belongings outside of these times is prohibited. The Club clears all abandoned items from lockers daily after closing.
6. Visitors must return locker keys to the administration upon leaving the Club.
Equipment & Facility Use
1. All Club Members and visitors must handle Club property with care, including Member cards and equipment. Sports equipment must be used only for its intended purpose. Throwing or misusing equipment is strictly prohibited.
2. Towels must be used during classes and while using shared equipment. Towels can be rented at the Club reception at the price listed in the service price list.
3. Visitors are required to return all equipment to its designated place after use. Exercise bikes must have seats and handles adjusted back to the default position and cleaned. Treadmills and other machines must be returned to the starting position. All equipment must be cleaned with the designated disinfectant after use.
4. Only disinfectants provided by the Club may be used within Club premises. Visitors are not permitted to bring or use personal cleaning products.
Group Classes & Personal Training
1. Group class reservations can be made either directly with the class leader/trainer or at the Club reception, in accordance with the Club’s registration procedures.
2. Visitors must arrive on time for group classes. Being late may increase the risk of injury due to incomplete warm-up. The Club reserves the right to give the reserved spot to another visitor, and trainers may deny late arrivals from joining the class even if a spot is reserved.
3. If a visitor must leave a group class early due to extraordinary circumstances, the trainer must be informed prior to the start of the class.
Payments, Subscriptions & Campaigns
1. Payments for Club services can only be made in cash or via bank transfer, in accordance with the Club’s accepted payment methods.
2. The Club may organize promotional campaigns during which granted benefits, discounts, or offers are valid only for the specified period and exclusively for persons meeting the campaign criteria. Campaign rules are binding, and benefits outside the defined conditions are not applicable.
Theft, Damage & Liability
1. Any theft committed by a Club visitor will result in an immediate lifetime ban from the Club. In such cases, any fees paid for subscriptions or visits are non-refundable. The Club reserves the right to claim compensation for losses caused by theft.
2. The Club reserves the right to demand full compensation from visitors for direct material damages resulting from their actions or negligence, including damage to equipment, premises, or other Club property. Compensation will be determined based on actual losses.
3. The Club is not responsible for clients’ personal belongings. Valuable items should be stored in designated locations as instructed by Club administration. The Club is not responsible for items stored elsewhere.
4. The Club is not responsible for deterioration of health, illnesses, injuries, or other accidents resulting from a visitor’s own actions, unless caused by the Club’s intentional misconduct or gross negligence.
Legal & Agreements
1. The Club may use special software and systems to store personal data provided by clients, in accordance with applicable laws and regulations.
2. Only persons approved or employed by the Club may provide services such as training, consulting, or classes. Visitors are not permitted to offer these services to others without written permission from the Club administration. Violations may result in unilateral contract termination and access denial.
3. Clients agree to immediately notify the Club of any changes to their personal or contact information.
4. Matters not explicitly regulated in the Agreement are governed by the applicable laws of the Republic of Latvia.
5. All disputes arising from or related to the Agreement should first be resolved through negotiations. If an agreement cannot be reached, disputes will be settled in court according to the laws of the Republic of Latvia.
6. Unless otherwise stated in the Agreement, neither Party may disclose information about the Agreement or its terms to third parties.
7. The Club processes Members’ personal data in compliance with the General Data Protection Regulation (GDPR) and other applicable laws, in accordance with the Club’s Privacy Policy.
8. The Club’s internal rules and Privacy Policy are drafted and available in three languages. Texts in other languages are for informational purposes only. In case of a dispute, the English version prevails.
Miscellaneous Rules / Enforcement
1. Lost and found items are stored at the reception for 14 days. Clients may claim items during Club working hours.
2. Visitors must leave the Club premises before closing time according to the published schedule.
3. In case of rule violations, Club administration has the right to ask the visitor to leave, impose a fine of one hundred (100) EUR, deny access for a specified period, or unilaterally terminate the agreement. In such cases, fees for subscriptions or visits are non-refundable.
